Terms of Service

1. Acceptance of Terms

By accessing or using Event Parlour ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including without limitation organizers, attendees, vendors, and other visitors ("Users").

2. Description of Service

Event Parlour is an event management platform that enables users to:

  • Create, manage, and promote events
  • Sell and purchase event tickets
  • Process payments for paid events
  • Manage workspaces and team members
  • Build communities through channels
  • Transfer tickets between users
  • Scan and verify tickets at events
3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You may sign up using:

  • Email and password
  • Google OAuth (subject to Google's Terms of Service)

3.2 Account Requirements

  • You must be at least 18 years old to create an account
  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

3.3 Account Types

  • Organizer: Users who create workspaces and events
  • Attendee: Users who purchase tickets and attend events
  • Users may have both roles simultaneously
4. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Post false, misleading, or fraudulent information
  • Create events that are illegal, harmful, or violate our Acceptable Use Policy
  • Use the Service to spam, harass, or abuse other users
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) without permission
  • Resell tickets in violation of event organizer policies
  • Create multiple accounts to circumvent restrictions or fees
5. Event Organizer Responsibilities

If you create events on our platform, you agree to:

  • Provide accurate and complete event information
  • Honor all ticket sales and deliver the event as described
  • Comply with all applicable laws and regulations
  • Obtain necessary permits, licenses, and insurance
  • Process refunds in accordance with our Refund Policy and applicable laws
  • Maintain appropriate security and safety measures at events
  • Respond to attendee inquiries in a timely manner
  • Complete KYC verification if required for payment processing
6. Payments and Fees

6.1 Platform Fees

Event Parlour charges a platform fee of 7.5% on all paid ticket sales. This fee is deducted from the ticket price before payment is processed to the organizer. Additional payment processor fees (Paystack, Stripe, M-Pesa) may apply and are separate from our platform fee.

6.2 Payment Processing

Payments are processed through third-party payment providers (Paystack, Stripe, M-Pesa). By making a payment, you agree to the terms and conditions of the applicable payment provider. We are not responsible for payment provider errors or issues.

6.3 Currency

We support payments in USD and KES. Currency conversion rates are determined by payment providers and may vary.

6.4 Withdrawals

Organizers may withdraw earnings subject to KYC verification, minimum withdrawal amounts, and processing times. Withdrawal fees may apply. See our Events Policy for details.

7. Refunds and Cancellations

Refund policies are determined by event organizers, subject to our platform policies and applicable laws. Please review our Refund Policy for detailed information about refund eligibility, processing, and fees.

Event cancellations or postponements are the responsibility of the event organizer. We will assist in processing refunds as per the organizer's policy and our platform terms.

8. Intellectual Property

8.1 Our Content

The Service, including its original content, features, and functionality, is owned by Event Parlour and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Your Content

You retain ownership of content you create, post, or upload to the Service (including event descriptions, images, and channel posts). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of providing and promoting the Service.

8.3 User-Generated Content

You are responsible for ensuring you have the right to post any content you upload. You agree not to post content that infringes on the rights of others, including copyrights, trademarks, or privacy rights.

9. Third-Party Services

Our Service integrates with third-party services, including:

  • Google OAuth: For authentication. Your use of Google OAuth is subject to Google's Terms of Service and Privacy Policy.
  • Payment Providers: Paystack, Stripe, M-Pesa for payment processing. These providers have their own terms and privacy policies.
  • Hosting and Infrastructure: We use third-party services for hosting, database management, and infrastructure.

We are not responsible for the practices or policies of third-party services. Your interactions with third-party services are solely between you and the third party.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • Events will occur as scheduled or described
  • Ticket purchases will result in event attendance
  • The Service will meet your specific requirements
11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVENT PARLOUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Event cancellations, postponements, or changes
  • Payment processing errors or failures
  • Unauthorized access to or alteration of your data
  • Third-party conduct or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Event Parlour, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

13. Termination

13.1 By You

You may terminate your account at any time by contacting us or using account deletion features in your settings.

13.2 By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the Service or other users.

13.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account and data, subject to legal retention requirements. Outstanding payments and obligations will survive termination.

14. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through:

  1. Good Faith Negotiation: Parties will attempt to resolve disputes through direct communication
  2. Mediation: If negotiation fails, parties agree to mediation before a neutral mediator
  3. Arbitration: If mediation fails, disputes will be resolved through binding arbitration in accordance with applicable arbitration rules

You waive your right to participate in class-action lawsuits or class-wide arbitrations.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms will be subject to the jurisdiction of competent courts as determined by applicable law.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and other referenced policies, constitute the entire agreement between you and Event Parlour regarding the Service and supersede all prior agreements and understandings.
